Vascular Solutions Falls 5% In Patent Dispute Setback Against Boston Scientific

Shares of Vascular Solutions (VASC) fell more than 5% after a federal appeals court vacated a preliminary injunction against Boston Scientific (BSX) in a patent dispute between the companies.

The U.S. Court of Appeals action related to a preliminary injunction issued in Minnesota district court in January against Boston Scientific’s Guidezilla guide extension catheter.

The Court of Appeals said a preliminary injunction is a “drastic and extraordinary remedy that is not to be routinely granted” and “at this stage of the case the record is too incomplete . . . to warrant the grant of a preliminary injunction.”

Vascular Solutions said the patent litigation is scheduled to go to trial in March.

In early afternoon grade, VASC was down 5.46% to $22.69, and BSX was off 1.95% to $13.05.
